Agreement to Terms

When you use our website to place an order with us, these Terms and Conditions constitute a legally binding agreement between you and us. It is your responsibility to carefully read these Terms and Conditions before using this website. Your use of the nextprint.ie website is contingent upon your acceptance of our Privacy and Cookie Policy and these Terms and Conditions. Use of the nextprint.ie website will be considered acceptance of these Terms and Conditions. If you do not agree, you may not use the website. Please note that nextprint.ie has the right to modify these Terms and Conditions, and you should review them periodically.

Definitions

  • “Seller” means 3 Rock, trading as nextprint.ie.
  • “Buyer” means the person whose name is printed on the Order.
  • “Contract” means the order and Order Confirmation (incorporating any Special Conditions).
  • “Faulty” means containing a fault or defect; imperfect or defective.
  • “Goods” means the goods or services which the Seller is to sell in accordance with these Terms and Conditions.
  • “Order” means the Buyer’s order for Goods or services.
  • “Order Confirmation” means the Seller’s written confirmation pursuant to Condition 3(b).
  • “Price” means the price together with postage and packing in force at the date and time of the Order, subject to any promotional offer or discount then applicable.
  • “Person” means any person, firm, or company.
  • “Special Conditions” any conditions in relation to orders set out and designated as such in the Order Confirmation.
  • “Writing” includes email clearly bearing the names of the sender and the recipient.

Basis of Sale

  • These Terms and Conditions and any Special Conditions will govern the Contract to the exclusion of any other terms.
  • Any variation of these Terms and Conditions and the Special Conditions will only bind the Seller if agreed in writing between authorised representatives.
  • The Seller’s employees are not authorised to make any representations concerning the Goods unless confirmed by the Seller in writing.

Orders and Specifications

  • All Goods are offered for sale subject to availability and subject to the Seller’s acceptance of the Order.
  • The Seller reserves the right to reject any Order without obligation to provide a reason.
  • The Seller has a policy of continuous product development and may amend product specifications without notice.
  • Colours of Goods displayed on the website may differ from actual products due to variations in screen settings.

Price and Payment

  • All prices are exclusive of VAT, which is added at checkout along with delivery costs.
  • Payment must be made by credit card, debit card, or PayPal at the time of placing an Order.
  • The Buyer undertakes that all payment details provided will be correct, and that sufficient funds or credit facilities are available.

Delivery

  • The place for delivery will be as shown on the Order.
  • The Seller will endeavour to process and manufacture the Goods within the stated timeframe, but delivery dates are estimated and not guaranteed.
  • The Buyer must inspect the Goods upon delivery and sign a proof of delivery document.
  • If the Buyer fails to take delivery, the Seller is not obligated to refund the Price.

Risk and Property

  • Risk of loss or damage passes to the Buyer upon delivery.
  • Ownership remains with the Seller until full payment is received.

Returns, Refunds, and Rights of Cancellation

  • The Buyer may cancel an Order if the Seller fails to deliver within 28 days of the Order date.
  • Cancellation requests must be emailed to customerservice@nextprint.ie.
  • Faulty or damaged Goods must be reported within 3 days of delivery.
  • If Goods are faulty or damaged, the Seller may require a return or photographic evidence before issuing a reprint or refund.
  • Refunds will be processed within 14 days of cancellation notice.

Limitation of Liability

  • The Seller is not liable for short delivery or Faulty Goods unless notified in writing.
  • The Seller is not responsible for loss, damage, or costs caused by events beyond its control.
  • Liability is limited to the net purchase price of the Goods or services.
  • Buyers must ensure their computer systems are protected against viruses; the Seller is not responsible for damages from website use.

Intellectual Property

  • The Seller owns the website and its content, including text, graphics, logos, trademarks, and software.
  • nextprint.ie and 3:Rock trademarks may not be used for non-affiliated products or misleading purposes.
  • Buyers must not use the Seller’s services to infringe third-party intellectual property rights.

Data Protection

  • The Seller is a registered data controller under GDPR and the Data Protection Act 2018.
  • Personal data is processed per Data Protection Legislation. See our Privacy and Cookie Policy for details.

General and Miscellaneous

  • Notice: Notices must be in writing.
  • Governing Law: Irish law governs the Contract. Disputes fall under Northern Ireland’s courts’ non-exclusive jurisdiction.
  • Waiver: The Seller’s failure to enforce rights does not waive future enforcement.
  • Statutory Rights: These Terms do not limit statutory rights.
  • Severability: Invalid terms are modified or removed without affecting the remaining Terms.
  • Typographical Errors: The Seller does not warrant website content accuracy.
  • License: The Buyer receives a limited right to use nextprint.ie per its policies.
  • Off-Site Links: The Seller is not responsible for third-party website content.
  • User Registration: Buyers must be at least 18 and provide accurate details.
  • Suspension/Termination: The Seller may terminate accounts violating these Terms.
  • Removal of Materials: The Seller may remove any Buyer content deemed inappropriate.
  • Indemnification: The Buyer agrees to indemnify the Seller against claims from their website use.
  • Changes to Terms: The Seller may amend these Terms and its services at any time.
